Accessibility overlays have long been controversial. Among accessibility experts, testers, and disability advocates, they are widely viewed as misleading and ineffective.

Against this backdrop, Germany has taken a clear stance on the use of accessibility overlays. BIK testing bodies, which operate within Germany’s national accessibility testing system, have rejected accessibility overlays for compliance testing.

Their position is that websites using accessibility overlays are not accepted for testing under their system. We will see the rationale behind this in the following section.

What Is BIK?

BIK stands for Barrierefrei Informieren und Kommunizieren (Accessible Information and Communication). It is a German competence network focused on digital accessibility.

BIK develops and maintains the BITV testing methodology and coordinates a network of accredited testing bodies that carry out accessibility evaluations.

These testing bodies use BIK’s defined procedures to assess websites and determine whether test results can be published or a BIK certification mark can be awarded.


What Is BITV?

BITV stands for Barrierefreie Informationstechnik-Verordnung (Barrier-Free Information Technology Ordinance). It is Germany’s technical accessibility framework that explains how digital accessibility requirements are applied, tested, and evaluated in practice.

You can think of it as Germany’s local version of EN 301 549, the European standard that defines accessibility requirements for digital products and services. It adapts those requirements for use within Germany’s accessibility testing and evaluation framework.

It’s important to note that BITV does not introduce new accessibility requirements of its own. Instead, it is based on WCAG and EN 301 549, focusing on how these existing standards are applied, tested, and assessed within the German context.


Why BIK Testing Bodies Reject Accessibility Overlays

BIK testing bodies reject accessibility overlays because the accessibility of a website cannot be reliably tested or confirmed when overlays are used.

When an overlay is added, the website’s behaviour can change depending on the accessibility settings each user selects. One user might enable high contrast. Another might increase font size. Someone else might turn on multiple options at once.

Because different settings change how the site looks and works, testers cannot decide which version of the site should be tested. Without a single, stable version to evaluate, BIK testing bodies cannot reliably confirm accessibility.

As a result, BIK cannot publish test results (see note below) or allow the use of a BIK certification mark for websites that use overlay tools.

Note: When a website passes a BITV test, the results can be publicly released. This means the test outcome is published on official BIK or partner pages and can be shared as proof that the website was tested and found accessible.


What This Means for EAA Compliance in Germany

The rejection of accessibility overlays by BIK testing bodies does not affect EAA compliance.

The main reason is scope. BIK tests accessibility under BITV (explained in detail below), which applies mainly to the public sector in Germany. The European Accessibility Act (EAA), on the other hand, applies to the private sector across Europe, including Germany.

Because of this, BIK is not responsible for verifying accessibility under the EAA. In Germany, EAA compliance is handled by a separate, dedicated monitoring authority, not by BIK or the BITV testing framework (see our EAA in Germany guide for details).

That said, this does not mean accessibility overlays can be used to achieve EAA compliance. There are two main reasons for this.

First, overlays cannot make a website accessible. Because they operate as an additional layer on top of a site, they do not fix underlying accessibility issues. As a result, accessibility overlays cannot help you meet EAA requirements.

Second, this view is shared at the European level. In 2023, the European Disability Forum (EDF) warned that accessibility overlays do not make websites accessible or compliant with European accessibility legislation, including the European Accessibility Act.

The European Disability Forum (EDF) and International Association of Accessibility Professionals (IAAP) have issued a joint statement clarifying the limitations of a technology known as ‘accessibility overlay’ – and warned that this technology does not make websites accessible or compliant with European accessibility legislation.

The message is clear. Even though the EAA does not explicitly reject accessibility overlays, they are not a valid way to achieve EAA compliance.


The Takeaway: Do Not Rely on Accessibility Overlays

Accessibility overlays do not fix accessibility issues. They cannot make your website accessible, and they do not protect you from legal risk. In some cases, they can even make the browsing experience worse for people with disabilities.

Real accessibility requires fixing issues in the website’s design, code, and content so that it works properly for everyone, including people with disabilities. Anything else is a shortcut that fails users and leaves organisations exposed.
